Chapter 5 - The Library and Computer Centre
Statute 5.1 - The Victorian Universities and
Schools Examination Board - repealed
on 31 March 1979.
Statute 5.2 - The university library
1. In this statute or in any regulations or rules made hereunder
unless the contrary intention appears:
'library materials' means
books including e-books, serials bound, unbound and electronic, electronic data
bases, pamphlets,
microcard, microfiche, microfilm, films, slides, film strips,
gramophone records, audio tapes in cassettes or open reels, video
tapes in cassettes or open reels, floppy disks, optical disks,
magnetic tapes and any other electronic media, maps, photographs,
index cards, manuscripts, prints
items in the library’s digital repositories and any other materials, including
electronic resources, in possession of the library;
'the university library' (in this statute called 'the library')
means the area and precincts of buildings or parts of buildings
called libraries and includes all branch libraries of the university
(designated as branch libraries) both collectively and severally
as the case may be having regard to the context in which the expression
is used.
2. The university librarian shall be responsible
for the overall supervision and conduct of the library.
3. A person shall not use the library materials except in accordance
with this statute and any regulations and rules made hereunder.
4. Any student who contravenes this statute or any of the regulations
or rules made pursuant to this statute shall be deemed to have committed
an act of misconduct for the purposes of Statute 4.1 - Discipline.
5. The university librarian may, in accordance with and subject to
any regulations and rules made hereunder, withdraw the right of any
person to enter the library or to take its library materials on loan
or both.
6.1 The Council may make regulations for and with respect to the
use of the library including, without limiting the generality of the
foregoing:
6.1.1 prescribing the extent to which and the conditions on which
any library materials may be used by any class of persons;
6.1.2 prescribing the fees for late return or compensation payable
for the late return of or failure to return any library materials
that have been taken on loan from the library;
6.1.3 prescribing the requirements to be met by any person wishing
to take on loan any library materials pursuant to this statute or
regulations or rules;
6.1.4 prescribing rules of conduct to be complied with by persons
using the library;
6.1.5 prescribing the conditions upon which the university librarian
may withdraw the right of any person to enter the library or to take
its library materials on loan or both;
6.1.6 prescribing or providing for any other matter or thing for which
it is necessary or expedient to prescribe or provide for the purposes
of this statute; and the Council may make regulations amending or
revoking such regulations.
6.2 Regulations made under this statute must be promulgated on the Monash University Calendar website
and after being so promulgated must remain on the website for at least 14 days.
7. This statute and any regulations made thereunder
do not apply to or in relation to a library on a campus outside
Australia.

Statute 5.3 - The Computer Centre
1. Interpretation
In this statute and in any regulations or rules made hereunder, unless
the contrary intention appears:
1.1 'committee' means the Computer Centre Committee;
1.2 'the Computer Centre' means the computer facilities of the university
under the control of the director and includes the areas and precincts
of buildings or parts of buildings in which computer facilities or
any annexe thereof under the control of the director are situated;
1.3 'the director' means the director of the Computer Centre or the
person acting as director for the time being;
1.4 'other authorised staff member' means the deputy director, or
the person acting as deputy director for the time being, and each
member of staff of the Computer Centre authorised by the director
to be an authorised staff member pursuant to this statute;
1.5 'regulations' means the Computer Centre regulations made pursuant
to section 6 of this statute;
1.6 'rules' means the Computer Centre rules made pursuant to section
7 of this statute.
2. The Computer Centre Committee 2.1 There shall be a Monash University Computer Centre Committee
which shall be constituted by resolution of the Academic Board as
a standing committee of the board;
2.2 All information stored in the Computer Centre shall be stored
upon such terms and conditions as the university acting on the advice
of the Computer Centre Committee shall impose.
3. Purpose of centre
The committee shall be responsible for all matters concerning the
Computer Centre and the provision of comprehensive computing services
in the university for teaching, research and administrative purposes
and for such other functions and undertakings as the Council or the
Academic Board may from time to time determine.
4. The director
4.1 The director of the Computer Centre shall be appointed by the
Council.
4.2 The director shall have executive responsibility for the management
and administration of the Computer Centre.
4.3 During each year the director shall submit to the Academic Board
a report on the operation of the Computer Centre during the previous
year which report he has first presented to the Computer Centre Committee
for discussion and comment.
5. Use of centre
A person shall not use the Computer Centre except in accordance with
this statute and the regulations or the rules.
6. Regulations
The Council may make regulations with respect to:
6.1 authorising the use of the Computer Centre or any part thereof
by any person or class of persons;
6.2 prescribing the fees or penalties or compensation payable by any
person or class of persons for the breach of any regulation or rule
or for misuse or excessive use beyond authority of any of the facilities
of the Computer Centre;
6.3 authorising the director to control the use by any person or class
of persons of the Computer Centre or any of its facilities;
6.4 prescribing the persons who may be authorised to have access to
the facilities of the Computer Centre and who may have access to or
retrieve information contained therein;
6.5 authorising the director to withdraw the right of any person or
class of persons to enter the Computer Centre or to use the Computer
Centre facilities; and
6.6 prescribing or providing for any other matter or thing for which
it is necessary or expedient to prescribe or provide for the purposes
of this statute and the Council may make regulations amending or revoking
such regulations.
7. Rules
The committee with the consent of Council may make rules which shall
be called the Computer Centre rules for and with respect to:
7.1 the conditions of use of the Computer Centre or any part thereof
by any person or class of persons;
7.2 the requirements to be met by any person or class of persons wishing
to use any of the Computer Centre facilities;
7.3 rules of conduct to be complied with by any person or class of
persons using the Computer Centre;
7.4 defining and enumerating the powers of the director to control
the use by any person or class of persons of the Computer Centre or
any of its facilities;
7.5 specifying the conditions upon which the director may withdraw
the right of any person or class of persons to enter the Computer
Centre or to use the Computer Centre facilities; and
7.6 prescribing the fees payable for use of Computer Centre facilities
by any person or class of persons and the committee may with the consent
of Council make rules amending or revoking such rules. Such rules
may be made so as to apply only to a specified part of the Computer
Centre.
8. Promulgation
Regulations and rules made pursuant to this statute shall be promulgated
by being exhibited on a notice board provided for the purpose in the
University Offices building and in the Computer Centre and after being
so promulgated shall remain so exhibited in the University Offices
building for at least fourteen days not counting days on which the
university is on holidays and whilst they continue to be in force
shall be exhibited in the Computer Centre.
9. Appeals
9.1 A person on whom a penalty is imposed pursuant
to the regulations or rules made hereunder, may within
twenty one days of the date upon which the penalty
is so imposed, appeal against the imposition of such
penalty in accordance with the following provisions
of this section.
9.2 A student may appeal against the imposition of the penalty to
the Discipline Committee pursuant to that statute; and
9.2.1 such appeal shall be deemed to be an appeal pursuant to section
6 of that statute;
9.2.2 the Discipline Committee in addition to the penalties it may
impose pursuant to that statute, may also impose any of the penalties
which may be imposed pursuant to the regulations made pursuant to
section 6 of this statute.
9.3 A person being a staff member or other person in relation to whom
Statute 4.1 - Discipline does not apply, may appeal against the imposition
of the penalty to the vice-chancellor who may hear the appeal in such
manner as the vice-chancellor thinks fit and for this purpose the
vice-chancellor may appoint a person being a member of the university
or a body of persons comprising members of the university to hear
the appeal on his behalf;
9.4 A person who has lodged an appeal pursuant to this section may
pending the resolution of such appeal apply to and be granted permission
by the director to use the facilities of the Computer Centre pending
the resolution of such appeal subject to such conditions as the director
may impose.
