Graduate and Postgraduate Certificates


1. Certificates

1.1 The certificates listed in the schedule may be undertaken in the faculty pursuant to these regulations.

1.2 The Graduate Certificate in Law may be undertaken in the specialty of Tribunal Procedures.

1.3 The Graduate Certificate in Forensic Studies may be undertaken or in the specialty of -

1.3.1 Accounting; or

1.3.2 Construction and Engineering

1.4 Where a graduate certificate is undertaken in a specialty, the title of the graduate certificate includes the name of the specialty in brackets.


2. Interpretations

In these regulations unless the contrary intention appears -

"approved" means approved by the faculty board;

"candidate" means a candidate for a certificate;

"certificate" means a graduate or postgraduate certificate listed in the schedule;

"course of study" means the course of study for a certificate determined by or under these regulations;

"faculty" means the Faculty of Law;

"faculty board" means the faculty board of the faculty;

"faculty information handout" means a faculty handbook or such other publication concerning a course of study, whether bound, loose leaf or in electronic form, as the faculty board determines from time to time.


3. Admission to Candidature

3.1 Except as otherwise provided in subsection 3.2, the faculty board may admit to candidature an applicant who has -

3.1.1 qualified for a degree; or

3.1.2 other qualifications or experience -
which in the opinion of the faculty board constitute suitable preparation for the proposed course of study.

3.2 The faculty board may admit to candidature for the Postgraduate Certificate in Legal Practice, Skills and Ethics an applicant who has -

3.2.1 qualified in the university for the Bachelors of Laws or has other qualifications or experience which the faculty board is satisfied are equivalent or a satisfactory substitute; and

3.2.2 satisfactorily completed the units required by the Victorian Council of Legal Education for admission to practise in Victoria.


4. Course of Study

4.1 The course of study for a certificate comprises units determined by the faculty board under this section.

4.2 The faculty board may from time to time determine the unit requirements of a course of study and in relation to these requirements may determine any matter or thing including but not limited to -

4.2.1 number, content and duration;

4.2.2 sequence;

4.2.3 candidate attendance and participation;

4.2.4 credit points;

4.2.5 assessment;

4.2.6 satisfactorily completion.

4.3 The faculty board may determine special requirements for or in relation to a course of study undertaken in a specialty.

4.4 The faculty board must cause a determination under this section to be published in a faculty information handout.


5. Credit - Graduate Certificate in Law

5.1 Subject to this section, where the faculty board is satisfied that a candidate for the Graduate Certificate in Law has qualifications or experience equivalent to or a satisfactory substitute for work in the candidate's course of study, the faculty board may grant the candidate credit in respect of that work.

5.2 Credit under subsection 5.1 must not be granted in respect to more than 50 % of the work in a course of study.

5.3 A candidate granted credit under this section must complete the course of study within the time specified by the faculty board.


6. Mode of Candidature

6.1 The course of study for a graduate certificate may be undertaken by full-time or part-time candidature.

6.2 The course of study for the Postgraduate Certificate in Legal Practice, Skills and Ethics must be undertaken by part-time candidature.

6.3 A candidate for a graduate certificate may, with the consent of the faculty board, transfer from full-time to part-time candidature or vice versa and in this event the candidate must complete the course of study within the time specified by the faculty board.


7. Time limits

7.1 Subject to the regulations and except where otherwise determined by the faculty board in any particular case, a course of study must be completed in -

7.1.1 six months of full-time candidature; or

7.1.2 twelve months of part-time candidature


8. Intermission

The faculty board may from time to time grant a candidate intermission for a period not exceeding twelve months in total.


9. Qualification

A candidate who satisfactorily completes a course of study for a certificate -

9.1.1 qualifies for the award of the certificate; and

9.1.2 where the course of study is undertaken in a specialty, for the certificate in the specialty.


10. Compliance

10.1 Subject to this section, a candidate must comply with these regulations and with the relevant course of study requirements determined by the faculty board under these regulations, as in force or published from time to time.

10.2 Where the faculty board considers that a candidate has, since first enrolling for a certificate, been unreasonable adversely affected by any change in the regulations or course of study requirements, the faculty board must permit the candidate to qualify for the certificate under the regulations or course of study requirements in force or published at sometime during candidature, provided the faculty board is satisfied that the work so required to be completed is equivalent in standard to that currently required to complete the course of study.
