Faculties regulations


Regulations made pursuant to Statute 2.3 - The faculties

1. These regulations are made in accordance with the powers vested in the Council by the Act and by Statute 2.3 - The faculties.


Part I - Faculties

2.1 Where any person is to take or has taken office as a member of the faculty board of a faculty and is not otherwise a member of the faculty, the Council shall, if so requested by the faculty board, appoint that person to be a member of the faculty while he holds that office.

2.2
Each person appointed as a fellow of a faculty shall be appointed by the Council as a member of that faculty.

2.3 The Council may appoint classes of academic staff of offshore campuses as members of a faculty or faculties and of a department or a school of a faculty.


Part II - Departments and schools of faculties

3.1 Each faculty shall be divided into such departments and schools as are specified in part I of schedules 1 - 10 of these regulations.

3.2 In this part 'school' means a school of a faculty and does not include a multi-departmental school established under Statute 2.3.2 - Multi-Departmental Schools.

4.1.1 In each department and school of a faculty there shall be a chair or head who shall be appointed and may at any time be removed by Council and who, subject to the statutes and regulations, shall be responsible for the academic and administrative affairs of the department or school.

4.1.2 A chair or head of a department or school may be removed by Council only on the recommendation of the vice-chancellor and president where the vice-chancellor and president has received a complaint, which in his or her opinion is prima facie worthy of investigation, that a chair or head has failed to perform his or her duties satisfactorily. Such a recommendation may be made by the vice-chancellor and president normally after taking the advice of a committee of enquiry consisting of the deputy vice-chancellor or a pro vice-chancellor, the dean of the faculty concerned, or, if that dean is the complainant, the dean of another faculty nominated by the vice-chancellor and president, and the chair or head of another department or school in the faculty concerned nominated by the vice-chancellor and president. The chair or head concerned shall be given full details of the complaint, notice of the time and place of the inquiry and an opportunity to present to the committee evidence in writing or in person relevant to the substance of the complaint.

4.2.1 The chair or head of a department or school shall normally be a member of the department or school holding the rank of professor but in exceptional circumstances a reader or associate professor may be appointed.

4.2.2 A chair or head shall be eligible for re-appointment to that office.


4.3 At intervals of three years the dean of a faculty shall review the chairship of each department and school in the faculty and provide a report to Council.

4.4.1 On the recommendation of the faculty board of a faculty, the Council may appoint a deputy chair or deputy head of a department or school of that faculty.

4.4.2 A deputy chair or deputy head shall hold office for such period as the Council may determine. A deputy chair or deputy head shall be eligible for re-appointment to that office.

4.4.3 A deputy chair or deputy head shall have such powers and duties as are delegated to him or her by the chair or head of the department or school or by the faculty board.


4.5 Where:

4.5.1 the office of chair or head of a department or school is vacant or

4.5.2 the chair or head of a department or school is absent or

4.5.3 the chair or head of a department or school is holding the office of dean or acting dean
the deputy chair or deputy head shall act as chair or head of the department or school during the period of such vacancy or absence or whilst the chair or head is acting as dean or acting dean, unless the Council on the recommendation of the dean shall have appointed some other person as acting chair or acting head during such period.

4.5.4 Notwithstanding any of the foregoing provisions of this subsection, a chair or head in exceptional circumstances and with the approval of Council may delegate his or her responsibilities to an acting chair or acting head for a period not exceeding one year.

4.6 Subject to any resolution of Council, an acting chair or acting head or deputy chair or deputy head, whilst so acting as chair or head shall represent the department or school on the faculty board and shall have all the powers and duties of a chair or head.

4.7 Where:

4.7.1 the office of deputy chair or deputy head is vacant or

4.7.2 the deputy chair or deputy head is absent or is acting as chair or head of a department or school the Council either may appoint an acting deputy chair or an acting deputy head to act as deputy chair or deputy head of the department or school or may by resolution designate a member of the department or school to be acting deputy chair or acting deputy head during the period of such vacancy or absence or whilst the deputy chair or deputy head is so acting as chair or head.

4.8 Subject to any resolution of Council, an acting deputy chair or acting deputy head shall have all the powers and duties of a deputy chair or deputy head.


5. The members of a department or school shall be:

5.1 the members of the teaching staff appointed to the department or school and holding the rank of lecturer or above; and

5.2 the members of the teaching staff appointed to the department or school and holding full-time appointments as assistant lecturers.


6.1 Subject to subsection 6.3 the chair or head of a department or school shall call a meeting of the members of the department or school not less than seven times in each year.

6.2 One of the meetings called pursuant to subsection 6.1 shall be called as soon as practicable after the faculty budget for the year has been announced to discuss the budget and its effect on the faculty and the department or school.

6.3 Notwithstanding subsection 6.1 a department or school may be permitted by a faculty board to hold only four obligatory meetings (one of which shall be the meeting referred to in subsection 6.2) of all members of the department or school provided:

6.3.1 the department or school has appointed or elected an executive committee;

6.3.2 the faculty board considers the size of the department or school renders it inappropriate to call seven obligatory meetings in a year;

6.3.3 the executive committee of the department or school holds on behalf of the department or school, the three additional obligatory meetings and

6.3.4 it is proposed by the department or school that the agenda for and the minutes of the executive committee meetings held in lieu of the three obligatory meetings so dispensed with will be duly circulated to all members of the department or school.

6.4 From time to time the chair or head of a department or school may call a meeting either of all the members of the department or school or of those members of the department or school referred to in subsection 5.1 of these regulations or of those members of the department or school referred to in subsection 5.2 and the chair or head shall call any such meeting upon the written request of at least one-fourth of the members entitled to attend the meeting.

6.5 The quorum for any meeting held pursuant to this section shall be one-third of the number of members of the department or school entitled to attend and vote.

6.6 No member of a department or school who is a candidate for a masters or a doctors degree of the university shall, at any meeting held pursuant to this section, vote on any matter relating to any masters or doctors degree of the university whether or not it is the degree for which the member is a candidate and if any such member votes, his or her vote shall be disallowed.

6.7 A report of the proceedings and decisions of each meeting held pursuant to this section shall be forwarded to the faculty board.

6.8 A report of the proceedings and decisions of the meeting held pursuant to subsection 6.2 shall be forwarded to the dean of the faculty.

6.9 A matter referred to a department or school by the faculty board shall be considered and a decision made at the next meeting of the department or school following receipt of such referral.

6.10 Except as otherwise provided in these regulations, Statute 1.2 - Meetings shall apply to any meeting held pursuant to this section.

6.11 Except as provided in the statutes and regulations and in the usual rules relating to the conduct of meetings, the decision of any departmental or school meeting shall not be binding on the chair or head of the department or school.

6.12 The provisions of this section shall mutatis mutandis apply to meetings of members of the teaching staff of a faculty which is not divided into departments or schools provided that in such application:

6.12.1 when the faculty meets as a whole, the faculty shall be deemed to be a department or school and the dean of the faculty shall be deemed to be the chair or head of a department or school and

6.12.2 when the faculty meets in groups, each group shall be deemed to be a department or school and the chair or head of each group shall be deemed to be chair or head of a department or school.

Part III - Faculty boards

7. Pursuant to section 27(1D) of the Monash University Act 1958 the categories of membership of a faculty board shall be as follows:

7.1 under section 27(1D) of the Monash University Act 1958: the chancellor, the deputy chancellors, the vice-chancellor and president, and the dean of the faculty;

7.2 representatives of each department or school of the faculty as specified in part I of the schedule hereto relating to the faculty, together with such further members of the faculty as specified in part II of the schedule hereto; or where a faculty has not been divided into departments or schools representatives of the faculty as a whole;

7.3 representatives of any department or school responsible for the teaching of a full honours sequence of courses in the faculty;

7.4 representatives of any department or school responsible for the teaching of a compulsory course in the faculty;

7.5 the dean (or the dean's nominee) of any other faculty -

7.5.1 which is responsible, in the opinion of the registrar, for at least 75 per cent of the teaching of a subject which is a component part of a degree or a diploma taken in the faculty and for which one or more students of the faculty are enrolled;

7.5.2 one or more students who are enrolled in subjects at least 75 per cent of the course which, in the opinion of the registrar, is taught by the faculty;

7.6 such other persons as are not otherwise members of the faculty and are ex officio, elected or appointed members of the board;


7.7 such persons who are appointed to the board by virtue of an office held in the faculty.


8.1 The number of representatives and the manner of representation on each faculty board of the categories specified in section 7 above shall be as set out in the appropriate schedule to these regulations.

8.2 An acting chair or acting head of a department or school whilst so acting shall cease to be a representative on a faculty board in any other category.

8.3 The faculty board may appoint a member of a department or school not already being a member of the faculty board, as a member of the faculty board to replace a member of the department or school whilst that member is acting chair or acting head of the department or school.


9. The elections of the members of a faculty board shall be conducted generally in accordance with the provisions of Statute 9.1 - Election Procedure as far as they are applicable, subject to such provisions to the contrary as a faculty board may, with the approval of the registrar, from time to time determine are to apply to the election of any of its members.


10.1 Subject to subsection 10.2, any faculty or faculty board may at any time and from time to time determine the quorum for its meetings and while there is no such determination in force the quorum for any meeting of a faculty or a faculty board shall be one-third of the number of members of that faculty or faculty board.

10.2 In ascertaining the quorum for a meeting of a faculty or faculty board and in determining whether or not a quorum is present at such a meeting, the following members shall not be counted, namely, the chancellor, the deputy chancellors, the vice-chancellor and president, the member of the Council elected by the faculty, the university librarian or nominee, and any member holding an office which in the schedule hereto relating to the faculty is specified as an office to which this subsection applies.


11.1 A casual vacancy occurs in the case of an elected member of the faculty board of a faculty when the member's office and the office of any alternate for the member becomes vacant.

11.2 A casual vacancy is be deemed to have arisen if the member and any alternate for the member are absent from three consecutive meetings of the board without special leave granted by the board before the close of the last of those meetings

 

Part IV - Secretary to the faculty board

12. The secretary to the faculty and to its board, holding office pursuant to section 11 of Statute 2.3 - The faculties, shall undertake the responsibilities imposed upon him or her by and pursuant to Statute 3.5 - Administrative staff and subject thereto shall assist the dean in the administration of the faculty.


Part V - Teaching staff and student transfer

13. Notwithstanding anything to the contrary in these regulations, a reference to a member of the teaching staff appointed to a department or school of a faculty includes a reference to a member of the teaching staff appointed to a department or school of another faculty where the second mentioned department or school becomes a department or school of the first mentioned faculty.


14. A student who is currently enrolled in a faculty for admission to candidature for a degree, diploma or certificate which if awarded is to be awarded on the recommendation of the faculty board of another faculty is deemed to be enrolled in that other faculty.

4. One representative of each of the Department of Applied Art and the Department of Theory of Art and Design, other than the head, elected from among their number by the members of the academic staff of the rank of tutor and above, of the department.

5. One representative of the Gippsland Centre for Art and Design, other than the director, elected from among their number by the members of the academic staff of the rank of tutor and above, of the centre.

6. Each elected academic staff representative of a department or school may, in writing, appoint a member of the academic staff in the same department or school of the rank of tutor and above to be his or her alternate who may, in the absence of the elected representative, attend and vote at any meeting of the faculty board during such period as the elected representative thinks fit. The appointment of an alternate may be terminated at any time by the elected representative and terminates in any event when the term of office of the elected representative expires.

Under subsection 7.5

1. The dean of the Faculty of Arts or the dean's nominee.

2. The dean of the Faculty of Engineering or the dean's nominee.

3. The dean of the Faculty of Information Technology or the dean's nominee.


Under subsection 7.6

1. The librarian or the librarian's nominee.

2. Four currently enrolled undergraduate student representatives, being two from the Caulfield campus and one from each of the Gippsland and Peninsula campuses, elected from among their number by undergraduate students of the faculty on each relevant campus. Each elected representative will hold office for one calendar year.

3. Two currently enrolled student representatives from any postgraduate course in the faculty, one being a research student and one being a coursework student, each elected by postgraduate students of the faculty. Each elected representative will hold office for one calendar year.

4. Up to three persons who are interested in the work of the faculty, appointed by the board on the recommendation of the dean. Each appointed member will hold office for one calendar year.

Under subsection 7.7

1. Each associate dean of the faculty if not otherwise a member of the board.

2. The chairperson of the Occupational Health, Safety & Environment Committee of the faculty.

3. One or more office holders in any department or school of the faculty which, if in the opinion of the dean is not adequately represented on the board, appointed by the board for a specified term on the recommendation of the dean.

Under subsection 7.2

Representatives of each school of the faculty determined as follows:

1.1 the number of representatives of each school (other than the School of Humanities, Communications and Social Sciences) shall not be less than two and subject thereto shall be that figure, to the nearest whole number, which bears the same proportion to fifty three as the number of members of the faculty in that school bears to the total number of members of the faculty in all the schools (other than the School of Humanities and Social Sciences) of the faculty;

1.2 The number of representatives of the School of Humanities, Communications and Social Sciences shall be six;

1.3 the chair, head or director of a school shall be one representative of the school;

1.4 the other representative or representatives of a school shall be elected from among their number by the members of the faculty in the school of the rank of tutor and above, provided however that, unless there is no member of the required status available for office, where the number of other representatives is three or more, at least one shall be a professor, associate professor or reader, and where such number is six or more, each of at least two shall be a professor, associate professor or reader.

Under subsection 7.2

1. The representatives of a department, school or centre of the faculty shall be elected from among their number by the academic staff in the department, school or centre ranked at and above assistant lecturer (0.4 equivalent full time).

2. The number of representatives of each department, school or centre of the faculty shall not be less than two and subject thereto shall be that figure, to the nearest whole number, which bears the same proportion to twenty five as the number of academic staff in the department, school or centre ranked at and above assistant lecturer (0.4 equivalent full time) bears to the total number of academic staff in all of the departments, schools or centres of the faculty ranked at and above assistant lecturer (0.4 equivalent full time).

3. All necessary data to facilitate the election of academic staff representatives will be as recorded in the university's statistics as at 31 March in the year an election is held.

4. Each elected academic staff representative of a department, school or centre may, in writing, appoint a member of the academic staff in the same department, school or centre ranked at or above assistant lecturer (0.4 equivalent full time) to be his or her alternate who may, in the absence of the elected representative, attend and vote at any meeting of the board during such period as the elected representative thinks fit. The appointment of an alternate may be terminated at any time by the elected representative and terminates in any event when the term of office of the elected representative expires.

Under subsection 7.5

1. The dean of the Faculty of Arts or the dean's nominee.

Under subsection 7.6

2. One member of the general staff of the faculty (including for this purpose non-academic research staff) elected from among their number by the general staff of the faculty (including for this purpose non-academic research staff) employed at and above 0.4 equivalent full time. The elected member will hold office for one calendar year.

3. The elected general staff member of the faculty may, in writing, appoint a member of the general staff of the faculty employed at or above 0.4 equivalent full time to be his or her alternate who may, in the absence of the elected member, attend and vote at any meeting of the board during such period as the elected member thinks fit. The appointment of an alternate may be terminated at any time by the elected member and terminates in any event when the term of office of the elected member expires.

4. One currently enrolled undergraduate student representative from each campus on which the faculty operates elected from among their number by undergraduate students of the faculty on each relevant campus. Each elected member will hold office for one calendar year.

5. Two currently enrolled student representatives from any postgraduate course in the faculty, one being a research student and one being a non-research student, each elected by postgraduate students of the faculty. Each elected member will hold office for one calendar year.

6. One currently enrolled international student representative elected from among their number by international students of the faculty. The elected member will hold office for one calendar year.

7. One graduate representative from any course offered at any time by the faculty elected from among their number by graduates of the faculty. The elected member will hold office for one calendar year.

8. Up to three persons who are interested in the work of the faculty, appointed by the board on the recommendation of the dean. Each appointed member will hold office for one calendar year.


Under subsection 7.7

1. Each associate dean of the faculty if not otherwise a member of the board.

2. The head of each department of the faculty.

3. The head of each school of the faculty.

4. The Chairperson of:

4.1 the Graduate Studies Committee of the faculty

4.2 the Undergraduate Studies Committee of the faculty; and

4.3 the Research Committee of the faculty

in each case if not otherwise a member of the board.


5. One or more office holders in any centre and school of the faculty which, in the opinion of the dean is not adequately represented on the board, appointed by the dean for a specified term.

Schedule 4 - Faculty of Education

Part II - Membership of the faculty board

Under subsection 7.1

1. The chancellor.

2. The deputy chancellors.

Under subsection 7.2

1. All professors of the faculty.

2. The campus coordinator of each campus on which the faculty operates.

3. Seven representatives of the faculty elected from among their number by the members of the teaching staff of the faculty for a term of two years, with at least two representatives from each of the Clayton, Peninsula and Gippsland campuses.

4. Up to four members of the faculty co-opted by the board for a term of twelve months.

Under subsection 7.3

Under subsection 7.5

1. The dean of the Faculty of Art and Design or the dean's nominee.

2. The dean of the Faculty of Arts or the dean's nominee.

3. The dean of the Faculty of Business and Economics or the dean's nominee.

4. The dean of the Faculty of Information Technology or the dean's nominee.

5. The dean of the Faculty of Law or the dean's nominee.

6. The dean of the Faculty of Science or the dean's nominee.

7. The dean of the Faculty of Medicine, Nursing and Health Sciences.


Under subsection 7.6

1. The librarian or the librarian's nominee.

2. The secretary to the Department of Education and Training or that officer's nominee.

3. One representative of the independent schools nominated by the Incorporated Association of Registered Teachers of Victoria.

4. The chief executive officer of the Catholic Education Office or that officer's nominee.

5. Two representatives of the general staff of the faculty elected from among their number by the general staff of the faculty.


6. Five students of the faculty appointed for a term of one year, being -

6.1.1 one research student appointed by the faculty board on the nomination of the Monash Education Research Community (MREC);

6.1.2 one postgraduate coursework student appointed by the faculty board on the recommendation of the dean;

6.1.3 one undergraduate or graduate student from each of the Clayton, Peninsula and Gippsland campuses appointed by the faculty board on the recommendation of the dean.


7. One alumnus of the faculty appointed by the faculty board on the recommendation of the dean for a term of two years.

8. Up to six representatives of professional associations and client groups interested in the work of the faculty, with at least one from a university sector, appointed by the faculty board on the recommendation of the dean for a term of two years.


Under subsection 7.7

1. In each case, if not otherwise a member of the board -

1.1 the associate deans and directors of the faculty;

1.2 the chairpersons of board standing committees.

1.3 the chairperson of the Equity and Access Committee of the faculty.

One professor (other than persons referred to in paragraph 7.2.1 above) from each multichair department or school nominated by the faculty board for a term of office of two years, to take office on 1 January of the year following the date of selection, provided that where there is more than one professor available, no one professor shall hold office for consecutive terms.


3.
Elected representatives of the faculty (other than those already appointed or selected under the preceding paragraphs under this subheading) determined as follows:

3.1 the number of elected representatives of each department and school shall not be less than three and subject thereto shall be that figure, to the nearest whole number, which bears the same proportion to twenty-five as the number of members of the faculty in that department or school bears to the total number of members of the faculty;

3.2 the elected representatives shall be full-time members of the teaching staff of the faculty of the rank of assistant lecturer (level A) and above;

3.3 each department and school shall be a constituency and the elected representatives of the faculty shall be elected in these constituencies from among their number.


Under subsection 7.3

Under subsection 7.4

1. The head of the School of Chemistry or the head's nominee.

2. The head of the School of Mathematical Sciences or the head's nominee.


Under subsection 7.5

1. The dean of the Faculty of Art and Design or the dean's nominee

2. The dean of the Faculty of Arts or the dean's nominee.

3. The dean of the Faculty of Information Technology or the dean's nominee.

4. The dean of the Faculty of Business and Economics or the dean's nominee.

5. The dean of the Faculty of Law or the dean's nominee.

6. The dean of the Faculty of Medicine, Nursing and Health Sciences or the dean’s nominee;

7. The dean of the Faculty of Science or the dean's nominee.

8. The dean of the Victorian College of Pharmacy or the dean’s nominee.


Under subsection 7.6

1. The librarian or the librarian's nominee.

2. The chair of the faculty's Industry Advisory Committee and such other external members as may be appointed by the board from time to time.

3.Two undergraduate students of the faculty

4. Two graduate students of the faculty, one research and one non-research, nominated by the board.

5. Two members elected from among their number by the general staff of the faculty.


Under subsection 7.7

1. The deputy dean of the faculty if not otherwise a member of the board.
