Collective bargaining, authorisation and harm to outsiders.

Collective bargaining by buyer groups or seller groups has been encouraged by recent federal governments as part of small business policy. Such bargaining can be authorised by the ACCC under the Trade Practices Act 1974 (cth) if the benefits outweigh the detriments. In this talk Professor King (a former Member of the ACCC) considers the ACCC's approach to authorisation. In particular he considers the effect of collective bargaining on parties who are 'outside' the buyer or seller group. The effect on these parties is rarely formally considered by the ACCC (or the Australian Competition Tribunal on appeal) despite economic analysis that suggests that these parties are often harmed by the collective agreement.
