Workplace and Corporate Law Research Group (WCLRG) seminar, Department of Business Law and Taxation -- CaulfieldPublished: 3 September 2008 Topic: Liability for Corporate Wrongs Christian will put an argument in favour of shareholder liability for personal injuries. He rejects the need to find control as the basis of liability. Liability is justified, instead, on the grounds that shareholders are company insiders who perform a distinct function - in arming companies with capital - and that the claims of personal injury claimants are of a higher order than any financial losses to be borne by shareholders. Personal injury claimants should be recognised as having the right to identify shareholders with their companies.
