Law seminar - the Brazilian judicial system

3 August 2005

Although the current Constituicao da Republica Federativa do Brasil (Constitution of the Federal Republic of Brazil) has boosted judicial independence and popular access to the courts, distrust in judges has paradoxically increased since the end of the military government, in 1985.

In fact, the performance of the judicial branch seems to have decayed since the country was re-democratised, as its judges are now constantly accused of corruption, nepotism, and excessive politicisation. The great paradox is that judicial independence has not always been beneficial to the rule of law in Brazil .

'The Brazilian judicial system: How judges undermine the rule of law in Brazil ', presented by PhD candidate Mr Augusto Zimmermann.
