2. Promotional materials

1. What key information has to be included in promotional materials?

s.107 requires written materials to identify registered provider and CRICOS number. The CRICOS course code does not have to be displayed but this is recommended as good practice

2. What info has to be given to students prior to accepting a student for enrolment?

Certain prescribed information has to be given to students pre acceptance and can be given electronically:

  • Information about the course: content, qualification, duration, teaching methods, assessment methods, details of arrangements with other providers (NC 21.1)
  • And facilities, equipment, learning resources (NC 21.2)
  • Itemised list of fees (NC 21.3)
  • English language proficiency (NC 21.4)
  • Copy of fees agreement (NC 22.1)
  • Local environment info (NC 23)
  • Dependant education requirements (NC 24)
  • Offers to include requirements for English language skills (NC 26)

3. What is the s.8 ESOS obligation

It is an offence to promote or provide a course without a registered provider ie must be registered on CRICOS before can offer or promote a course. Max. penalty 2 years imprisonment

4. What is the obligation if a course is jointly provided?

If a course jointly offered, if not registered, "must identify the registered provider (name and provider number) in any written material promoting the course (see section 107) and must not engage in misleading or deceptive conduct in relation to the course (see subsection 83(2))."

Further, the provider of a course may only advertise the provision of the course with the express permission of the registered provider (NC 20)

5. Should a flyer promoting Monash have CRICOS Para printed

s.107 of the ESOS Act says it is an offence to offer or promote a course without identifying the provider and provider Para in written materials.

If a leaflet does not offer or promote a particular course it would be difficult for DEST to contend that a course was being offered or promoted.

Nevertheless, it would be good practice to have the CRICOS Para printed (perhaps in the footer) on the leaflet itself. All standard Monash templates (letter/faxes/memo) now contain the CRICOS Para.

6. Should CRICOS Para be on all emails

The provide name and provider CRICOS code should be on all emails for staff who may be interacting with students

7. If a course is yet to receive university or course CRICOS approval can it be listed in the course guide?

The course can be listed in the course guide without description with the following statement boldly marked. "the faculty hopes to offer the following course in x00 but must first gain university approval and government CRICOS endorsement. Check the faculty website for latest information on availability to international students before making application. International student visas cannot be issued without a CRICOS code."

8. If a course is awaiting CRICOS approval can it be listed?

Include a statement: "Awaiting government CRICOS endorsement at time of publication. International student visas cannot be issued without a CRICOS code. Please check on the status of the course before making an application."
