National code

A. Policy

The National Code is established under section 37 of the ESOS Act 2000. To be registered on CRICOS, a provider must have been assessed by the relevant State or Territory registration authority, and certified as compliant with the National Code.

Providers who breach or fail to observe the national code are liable to have conditions imposed on their registration or have their registration suspended or cancelled. Fines may also be imposed. (s.44, 83, Reg.4.01)

Commonwealth can notify state authorities about suspected breaches of the code or in urgent cases, carry out its own investigations or other actions without notice (s.43)

The National Code purpose is to provide nationally consistent standards for CRICOS registration and for the conduct of CRICOS registered providers (NC 9)
