5. Application and Parties Bound

This Agreement will be binding upon Monash University (the “University”), the National Tertiary Education Industry Union (the “Union”) and their officers and upon academic and general staff of the University, however employed and whether members of the Union or not, with the exception of the following staff members :

• those appointed Vice-Chancellor, Deputy Vice-Chancellor, two Vice Presidents and successor positions;
• those who are subject to the application of the Monash University Enterprise Agreement (Trades and Services Staff - Building and Metal Trades Staff and Grounds and Gardening Staff) 2000, the Monash University Enterprise Agreement (Trades and Services Staff - Catering and Retail, Cleaning and Caretaking, and Miscellaneous Services Staff) 2000, or their successors, but excluding those staff engaged as Drivers or in printing and graphic arts;
• those subject to the management and direction of Monyx Education Services Pty Ltd, including those employed in and about the Churchill and Monash Leisure Centre, are excluded 12 months after the nominal expiry date of this Agreement and/or following the certification of an enterprise agreement between Monyx Education Services Pty Ltd and the NTEU, whichever is the earlier; and
• those who are party to an AWA, made before, on or after the date of this Agreement, that operates to the exclusion of this Agreement.
